David Eleff

Partner

A partner at SMR, David Eleff practices general civil litigation, acting for clients in a broad range of matters including personal injury, administrative law matters (including, professional regulation and disciplinary matters) and wills and estates litigation.  He has appeared at all levels of Court in British Columbia. David has achieved positive results for his clients in and out of the courtroom, including mediations, contested hearings, trials and appeals.

Originally from Manitoba, David practiced criminal defence in Winnipeg prior to moving out west in 2011.  Before joining SMR, David worked for one of British Columbia’s largest regulatory bodies as litigation counsel and prior to that, at a plaintiff personal injury firm.

David believes it is important to get to know his clients and goes to great lengths to ensure effective communication throughout the process.  Outside of the practice of law, David enjoys spending time with his young family, playing hockey and running the trails of North Vancouver.

Ahluwalia v. British Columbia (Workers’ Compensation Board), 2021 BCSC 399, Successfully defended a judicial review application of a tribunal decision relating to a claim of workplace bullying and harassment

McLaren v. Workers’ Compensation Board of BC, 2021 BCHRT 111, Successfully brought an application to strike the complainant’s claim of discrimination under the Human Rights Code

WCB v. Seattle Environmental Consulting, 2019 BCSC 1862, aff’d 2020 BCCA 365; Prosecuted an asbestos abatement company and its directing mind for civil contempt, resulting in the imposition of a custodial sentence

British Columbia (Workers’ Compensation Board) v. Barring2020 BCSC 1174, Obtained permanent injunctive relief prohibiting an individual from carrying on business in the asbestos abatement industry

Baun v. British Columbia (AG), 2019 BCSC 836, Successfully brought an application to strike the plaintiff’s petitions for judicial review of several tribunal decisions relating to her claim for compensation

Provost v. Bolton, 2017 BCSC 1608, Judgment obtained apportioning liability to the RCMP and others for a police chase of a stolen vehicle that resulted in a motor vehicle collision and serious injuries to the plaintiff (varied on appeal 2020 BCCA 86)
